Purchasing Conditions

Purchase of products on the website www.simboliccasabatllo.com (hereinafter, the "Website" or the "Store") attributes to the navigator the condition of user (hereinafter, the "User"), who, from the beginning of the purchase process, unequivocally accepts the purchasing conditions listed below:

1.1 User Requirements

The User undertakes to use the Store, to acquire the products, and to use the Store's services in accordance with the law, public order, with diligence, and the provisions of these general terms of sale, refraining from using it in any way that may prevent, damage, or deteriorate the normal functioning and enjoyment of the Website by Users, or that could harm or cause damage to the property and/or rights of Casa Batlló, its suppliers, Users, and in general, any third party.

In order to place an order, the User must be at least eighteen (18) years old and provide Casa Batlló with true information to formalize the sale.

1.2 Purchase Procedure

The contracting process through the online platform is carried out entirely electronically, for which only a series of steps described below need to be followed.

Any person with Internet access can carry out the contracting. This requirement is essential to start the contracting process and for the resulting contract to be valid.

Throughout the process, it is possible to view the different phases of the contracting. However, and in order for the User to have prior access to this information, the following phases are indicated:

1.2.1 Shopping cart

Phase in which the product is added to the electronic shopping cart available on the Website. All products included in the cart can be deleted and edited by the User if preferred.

Despite adding a specific product, the User can continue browsing, with all selected products included in the cart until clicking on the button to continue the contracting process.

If the User wants to continue with the contracting process, they must click on "Proceed to checkout."

1.2.2 User Identification

Phase in which the User must enter their "Shipping address" details. It is not necessary for the User to register to complete the purchase process. By entering their details, the User expressly accepts the Privacy Policy and these Conditions.

1.2.3 Selection of Shipping Method

Phase in which the User must indicate the shipping method they wish to contract. In this regard, the User can choose between the "UPS" or the "pickup in-store" option. By choosing the latter option, the User will be responsible for going to the address of Casa Batlló: Casa Batlló - Passeig de Gràcia, 43 08007 Barcelona.

1.2.4 Selection of Payment Method and Acceptance of Contractual Conditions

Phase in which the User must choose the preferred Payment method, being able to choose between Paypal or Redsys TPV. In both cases, the User must accept Casa Batlló's present conditions.

Afterwards, the User has the possibility to leave a comment and/or apply a discount code.

Finally, the User must click on "Proceed to payment," the last step of the contracting process, and where the User accepts the contractual conditions.

1.3 Products and Prices

Casa Batlló reserves the right to decide, at any time, which products to offer Users through the Website. Casa Batlló may at any time add new products, with such new products being governed, unless otherwise provided, by these purchasing conditions. Likewise, Casa Batlló reserves the right to cease providing or facilitating access to the offer without prior notice and at any time of any of the different types of products offered on the Website.

The products offered will correspond to the products actually offered as faithfully as possible, allowing for the technology available to Casa Batlló for display on the Website. However, the User is advised that handmade products may undergo slight variations inherent to the manual manufacturing process. The Website informs about the characteristics and prices of the products. The prices indicated on the website are in Euros and do not include VAT, unless indicated otherwise, also informing about the shipping costs in the purchasing process.

During the process of formalizing the purchase, Casa Batlló makes available to the User these conditions, which constitute the contract with the User, and can be stored and reproduced by the User.

1.4 Supply and Payment of Products

The User who purchases a product through the Website must make the payment through the specific payment systems detailed in the purchasing process.

Any order placed must be paid for immediately after the confirmation of the order. By placing an order, the User is making an offer to purchase the products they have selected subject to the sales conditions provided herein. Casa Batlló may, at its discretion, accept or not accept the offer.

From the moment of formalization, within a maximum period of twenty-four (24) hours, Casa Batlló will send an email to the User confirming the purchase, containing the essential conditions of the transaction, including these purchasing conditions, accepted by the User.

Casa Batlló will temporarily archive the electronic documents that formalize the sales contract, understood as the User's order and confirmation of the order. These documents will be drawn up in Spanish and English.

The order confirmation sent by Casa Batlló is not valid as an invoice, only as a proof of purchase. In the event that an invoice is required, the User may contact infostore@casabatllo.cat, to request it, or may tick the box: "Need Invoice."

The User has the right to receive the invoice on paper. To issue, where appropriate, the electronic invoice, Casa Batlló will previously obtain the express consent of the User, after requesting the form of sending the electronic invoice. The User who has given their consent to obtain the electronic invoice may revoke this consent, after having been informed by Casa Batlló of the way to formalize said revocation.

The User's right to receive the paper invoice will not be conditioned on the payment of any economic amount.

The prices of the items are specified in each product sheet. Casa Batlló reserves the right to modify prices at any time, in which case the valid price for the sale will be the one on the date of the online purchase.

Although Casa Batlló will make every effort to supply the User with the products listed in their order confirmation, there may be occasions when it is impossible to supply such products due, for example, to the fact that they are no longer manufactured, are not available, or that it is impossible to obtain from the manufacturer or distributor the products or any of their components. In these cases, Casa Batlló may offer the User, without increasing the price, an available product with similar characteristics of the same or superior quality, and the User may choose between this product or the refund of the price of the unavailable product, at their discretion. In this case, the User may exercise their rights of withdrawal and resolution under the same terms as if it were the initially requested item.

1.5 Home Delivery Service

The territorial scope of sales through the Website is global. Products purchased through the Website will be shipped to the delivery address provided by the User once payment is confirmed, without undue delay and within a maximum delivery period of thirty (30) calendar days from the date of formalization of the sale.

Casa Batlló's delivery service is carried out in collaboration with prestigious logistics operators. Orders will not be delivered to Post Office Boxes or to hotels or other non-permanent addresses. The cost of shipping is not included in the price of the products. At the time of purchasing the products, the User will be informed of the exact cost of shipping. The costs corresponding to customs and tariffs are not included in the price of the products and, if applicable, must be paid by the User. If the User does not pay these costs and/or in case of delays not attributable to Casa Batlló and/or the shipping company, the agreed period will be suspended until the cessation of these circumstances.

Products will not be shipped to countries whose legislation prohibits or does not contemplate home deliveries unless the User designates the address of a company and/or an appropriate address in that country to receive the delivery. In the event of non-compliance with this clause by the User, if new shipping costs are incurred by Casa Batlló, it may pass them on to the User.

The User undertakes to provide an address where the delivery of the order can be made within the usual delivery hours. If the User fails to comply with this obligation, Casa Batlló will not be liable for the delay or impossibility of delivery of the requested order.

Shipping costs include the specific insurance offered by the carrier. In the event of loss or damage, the User may be entitled to compensation. Such compensation will be subject to the corresponding claim by the User to Casa Batlló and by Casa Batlló to the shipping company, and will be effective only in the event of a response from the latter assuming responsibility for the loss or damage and the payment actually made by the latter as compensation in accordance with the conditions of the insurance included in its services.

Delivery will be considered to have been properly made upon delivery to the address provided and the signature on the corresponding delivery note from the courier company; regardless of whether it is a person other than the buyer. Except in cases where the buyer expressly specifies otherwise in the purchase, Casa Batlló will understand that the person at the designated address has authorization from the User to collect the product.

1.6 Right of Withdrawal

The User has the right to withdraw from their purchase contract within fourteen (14) calendar days without the need for justification. This period begins to run from when the User or a third party indicated by the User (other than the carrier), acquires physical possession of the goods (i.e., receives the product).

To exercise the right of withdrawal, the User may contact Casa Batlló by email at the following address: infostore@casabatllo.cat, and notify (their name, their complete address, and, if available, their telephone number, fax number, and email address) the decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax, or email).

Although the exercise of the right of withdrawal is not subject to formalities, to expedite its processing, it is advisable to return the product to be returned along with the completed return form and a copy of the delivery note or invoice, with the User or buyer bearing the costs of returning the product, including transportation, fees, duties, and other taxes that may arise as a result of the return, unless the User chooses to arrange with Casa Batlló the return at Casa Batlló's offices, in which case no additional cost will be incurred.

The right of withdrawal cannot be exercised when the products are not returned in their original packaging and when they are not in perfect condition.

Likewise, returns of items that may deteriorate or expire quickly, or of items that have been modified and/or personalized at the customer's request, or those unsealed items that, for health reasons, are not allowed (underwear, personal care items) will not be accepted. Casa Batlló will check if the products are in the same original conditions when returned. Items returned incomplete, damaged, or dirty will not be refunded.

Withdrawal will entail the refund of the amount paid for the product, excluding the transportation costs, fees, duties, and other taxes or expenses that the User has paid for the purchase, delivery, and return of the products. Casa Batlló will refund the return within fourteen (14) calendar days following the date of withdrawal, using the same means of payment used by the User for the initial transaction unless expressly otherwise instructed by the latter.

Casa Batlló may retain the refund until it has received the product, or until the User has provided proof of its return, whichever condition is met first.

In case of doubt or any incident, claim, and/or exercise of their rights, the User may send an email to the address infostore@casabatllo.cat.

1.7 Warranty

All products offered on the Website have a warranty of 3 years, which begins to run from the moment of delivery of the good.

In the event that the product is not in accordance with what was contracted, the buyer must notify Casa Batlló by postal mail or by sending an email to infostore@casabatllo.cat and will have the right to choose between correcting said lack of conformity, reducing the price or resolving the contract. For rectification, the buyer will have the right to choose between repair or replacement, unless one of these two options is impossible or, compared to the other corrective measure, involves disproportionate costs for the entrepreneur, taking into account all circumstances.

It is understood that the products are in accordance with the contract as long as (i) they comply with the description made on the Website, considering that they may be artisanal products (ii) they are suitable for the uses normally intended for products of the same type and (iii) they present the usual quality and characteristics of a product of the same type that are reasonably expected.

Likewise, the buyer must take into account that the legal guarantees of the products will not be valid if damage occurs due to incorrect treatment of the product or failure to maintain it in accordance with its instructions for use.

1.8 Return of Defective Products

In addition, Casa Batlló will accept exchanges or returns of defective products during the first month following the date of confirmation of receipt of the good. All products to be returned must be in the same condition in which they were delivered, with the original packaging and tags.

In case the purchase was made in one of our physical stores, it is essential to also present the purchase receipt for any exchange or return, as long as it is within the established period of 30 days from the date of purchase.

In cases where all return conditions are not met, Casa Batlló cannot accept it and will inform the User by email. Rejected items will be available to the customer for two (2) months, and they can collect them by prior notice at Casa Batlló (Pg. de Gràcia, nº 43, 08007 Barcelona, Spain), or request their shipping, previously assuming all costs of the new delivery.

1.9 Customer Service

For any incidents, complaints, or exercise of their rights, the User may send an email to the address infostore@casabatllo.cat, which will be attended to as soon as possible.
