1. TERMS OF USE.
1.1 MANDATORY INFORMATION ACCORDING TO THE LSSI
In accordance with the obligations established in Law 34/2002, on Information Society Services and Electronic Commerce (also known as the LSSI), CASA BATLLÓ, S.L.U. (hereinafter, "Casa Batlló") states that the Websites are owned by Casa Batlló, with Tax Identification Number B-62.401.534, and registered office at Pg. de Gràcia, nº 43, 4th floor, 08007 Barcelona (Barcelona), and contact email address info@casabatllo.cat.
Casa Batlló is registered in the Commercial Registry of Barcelona, in volume 41.871, folio 183, sheet number B-223.546.
1.2 INTELLECTUAL PROPERTY
Casa Batlló holds the intellectual property rights over the various contents displayed on the Websites, such as, among others, texts, graphics, user interfaces, visual interfaces, photographs, images, illustrations, programming code, color combinations, plans, and audio and video files, or, where applicable, third-party permissions for their use. Likewise, Casa Batlló holds the intellectual property rights derived from the structure, selection, arrangement, and presentation of such contents, with Casa Batlló being the one who controls and authorizes the use of these materials protected by current regulations.
The reproduction, distribution, public communication (also in the form of making available to the public), and transformation of such contents, whether total or partial, and/or any uses of contents owned by Casa Batlló, and not expressly provided for by current legislation, will only be possible through a contract signed with Casa Batlló and in accordance with the terms and conditions stipulated therein.
Unauthorized use of the content displayed on the Websites may lead to the exercise of legal actions by Casa Batlló, including the claiming of damages.
Any User interested in making use, of any kind, of the photographs in the gallery contained on the Websites, may request a usage license from Casa Batlló at the contact addresses provided on said page.
1.3 INDUSTRIAL PROPERTY
Casa Batlló holds a series of trademark registrations that protect both the image of the characteristic facade of Casa Batlló and the name "Casa Batlló" itself, as well as other figurative elements, for a wide variety of products and services. Casa Batlló is responsible for the commercial exploitation of the trademark registrations, both directly and through licensing to third parties.
The exploitation of the aforementioned trademark registrations by third parties will only be possible through a contract signed with Casa Batlló and in accordance with the terms and conditions stipulated therein.
Unauthorized exploitation of the aforementioned trademark registrations or any other sign that may be identical or similar, to distinguish any products and/or services, may lead to the exercise of legal actions by Casa Batlló, including claims for damages.
In the contact section provided on the Websites for this purpose, any User interested in obtaining a license for the use of trademarks owned by Casa Batlló may submit a license request.
The Websites may occasionally display links to other websites, without implying the existence of a legal relationship between Casa Batlló and those websites and/or their owners, and without Casa Batlló assuming responsibility for the content of the linked website, which will be the responsibility of its legitimate owner, in accordance with applicable law.
Casa Batlló prohibits third parties from using "Casa Batlló" or any of the addresses of the Websites or confusingly similar signs as frames or tags to link to third-party pages, considering the trademark rights that Casa Batlló holds over the name "Casa Batlló," and to the extent that applicable law does not establish otherwise.
1.4 LINKS
Connections and links to third-party websites or pages have been established solely as a utility for the User. Casa Batlló is not, in any case, responsible for them or their content.
Casa Batlló assumes no responsibility arising from the existence of links between the content of this site and content located outside of it or from any other mention of external content to this site. Such links or mentions are for informational purposes only and, in no case, imply endorsement, approval, commercialization, or any relationship between Casa Batlló and the individuals or entities responsible for or managing such content or owners of the sites where they are found.
1.5 PROHIBITED USES ON THE WEBSITES
Accessing or using the Website for illegal or unauthorized purposes, with or without economic intent, is not allowed and, therefore, the consequences will be the sole responsibility of the User. Specifically, and without this list being exhaustive, it is prohibited to:
Use the Website in any way that may cause damage, interruptions, inefficiencies, or defects in its functionality or in the device and/or computer of a third party;
Use the platform for the transmission, installation, or publication of any viruses, malicious code, or other harmful programs or files;
Use the Website to collect personal data from other Users;
Include false contact information, impersonate third parties, or take any other action that may confuse the identity of the User;
Breach, or attempt to breach, the security or authentication measures of the Website or any network connected to it, or the security or protection measures inherent in the content offered on the Website;
Carry out any action that causes disproportionate or unnecessary saturation in the platform's infrastructure or in Casa Batlló's systems or networks, as well as in systems and networks connected to the Website; or
Prevent the normal development of any activity available through the Website or any of its functionalities, either by altering or attempting to alter, unlawfully or otherwise, access or operation, or by using fraudulent methods, through any procedure, and/or through any practice that undermines or violates this Legal Notice in any way.
Failure to comply with any of the above obligations by the User may result in Casa Batlló taking appropriate measures permitted by law and in the exercise of its rights or obligations, which may include the removal or blocking of the participation of the infringing User, without the possibility of any compensation for damages.
1.6 BLOCKING FOR BREACH OF TERMS OF USE
The User is informed that Casa Batlló may, without prior notice and at its discretion, disable User access to the Website or block them if it considers that they have breached the terms of use or other agreements or guidelines associated with the use of the Website. Likewise, the User is reminded that the breach of these terms of use may constitute an unlawful and unfair business practice, and may cause irreparable harm to Casa Batlló for which compensation may be sought.
If deemed appropriate, Casa Batlló may communicate, in accordance with applicable law and solely to competent police or judicial authorities, any data necessary or essential to conduct an investigation or claim arising from the User's use of the Website, or to identify, contact, or take legal action against anyone who has interfered with or caused harm (intentionally or unintentionally) to the proprietary rights of Casa Batlló or the Users of the Website, including Casa Batlló's customers. Casa Batlló reserves the right to disclose any data it deems relevant at any time to comply with laws, regulations, judicial procedures, or government requests.
1.7 LIABILITY IN CASE OF MALFUNCTION OF THE WEBSITE
Casa Batlló does not guarantee that the Websites (content, services, and/or their performance) may be free of errors, and/or uninterrupted, nor is it obliged to correct errors, or that the User's use of the Websites will result in a specific outcome. The Websites and their content are offered as is and subject to availability. All information published on the Websites is subject to change without prior notice. Despite efforts to prevent it, Casa Batlló cannot ensure that files or other data downloaded from the sites may not contain viruses or other similar features, and is not responsible for the adverse effects they may cause to Users. In the event of disagreement with these legal conditions, the User must refrain from using it, with this limitation of liability forming part of the consensus between the parties.
The exemption described in the preceding paragraph applies to damages, liabilities, and/or losses caused by any failure in operation, errors, omissions, interruptions, deletions, defects, delays in operation and/or transfer, viruses, communication line failures, theft, destruction, unauthorized access, alterations, and/or unauthorized use, whether due to breach of contract, negligence, and/or any other cause.
Except in cases expressly prohibited by law, Casa Batlló shall not be liable for indirect, incidental, or consequential damages, including loss of profit, even if it had knowledge of the possibility that such damages might occur.
1.8 PASSWORDS
Casa Batlló may provide the User who registers as such on the Website with personal passwords. These passwords will be used to access the services provided through the Website. The User shall keep the passwords under their sole responsibility in the strictest and utmost confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. The User is solely responsible for diligently maintaining the password and ensuring its confidentiality, thereby exempting Casa Batlló from any accesses by third parties that may occur due to the User's lack of diligence in conservation.
For security reasons, the telematic access password to the services linked to the Website may be modified at any time by the User, or by Casa Batlló when it suspects that someone other than the legitimate User may be using it. The User agrees to immediately notify Casa Batlló of any unauthorized use of their password, as well as unauthorized access by third parties to the same.
1.9 USE OF SOCIAL NETWORKS
The presence and dissemination of Casa Batlló, by its owners, on Facebook, Twitter, Instagram, Flickr, Youtube, Google Plus, Vimeo, LinkedIn, Pinterest, Snapchat, Weibo, and Wechat, and on new social networks that may arise in the future, are managed by Casa Batlló. Access to and use of these platforms requires acceptance of the general conditions specific to each platform and is governed by the rules and privacy policy detailed below. 1.8.1 Permitted and Prohibited Uses on Casa Batlló's Social Networks
Casa Batlló's profiles on the aforementioned social platforms serve as spaces for exchange, knowledge, and dissemination of the work of Antoni Gaudí and Casa Batlló. Users can publish and exchange information and content, as well as establish communication among themselves. Followers of each profile are obligated to use each platform correctly, comply with the specific rules of each platform, and also with those detailed here. Casa Batlló is not responsible for the content published by Users, nor does it identify with any of the opinions that Users post on the profiles. Additionally, Casa Batlló reserves the right to hide or block comments or Users that violate the following rules:
Advertising: Spam is prohibited, so comments with advertising content and/or unrelated to the theme of the Facebook page will be deleted.
Tone: Comments that insult, belittle, threaten, or offend the sensibilities of other Users, page administrators, Casa Batlló staff, and/or any third party are not permitted. Therefore, any disrespectful comments will be hidden, and in case of recurrence, the User may be blocked.
Security: For security reasons, the publication of personal data in comments is not allowed. Any comment containing personal data may be deleted.
Legality: Comments that constitute violations of any current regulations may be deleted.
1.8.2 Intellectual Property, Industrial Property, and Third-party Rights
The content published on Casa Batlló's social networks may be authored and owned by Casa Batlló, or by third-party authors who have freely published such content on the aforementioned networks and have previously authorized Casa Batlló to share, disseminate, and/or republish such content (including photographs) on all of Casa Batlló's social networks. Casa Batlló will cite these Users by their real name and/or their User name.
If the author of a content (including photographs) wishes to withdraw said content, Casa Batlló S.L.U. will respect the right of said User to withdraw said content (including photographs) from any of our profiles, upon notice via online private messaging through the social network itself or by email to marketing@casabatllo.cat, indicating "Image Withdrawal" in the subject line. Casa Batlló undertakes to remove the image as soon as possible, within a maximum of ten (10) business days.
1.8.3 Modifications
Casa Batlló may modify and/or replace these terms of use for its social networks at any time, which will replace, supplement, or modify the previously published conditions.
1.10 POSSIBLE NULLITY DECLARATION OF CONDITIONS
In the event that any of the present conditions is judicially declared null and void, the validity of the rest of the conditions contained herein and unaffected by said declaration of nullity shall remain in force, maintaining the spirit and purpose of these general conditions.
1.11 PRIVACY AND COOKIE POLICY
In accordance with the provisions of the current and applicable legislation on the Protection of Personal Data, all personal data provided during access and use of the Website will be processed in accordance with the provisions of the Privacy Policy that every User must expressly accept in order to access and use the Website.
Every User who accepts this Legal Notice does so informed, expressly, and unequivocally accepting our Privacy Policy and Cookie Policy, and may exercise the rights corresponding to them in this matter, as informed in the aforementioned Policies.
1.12 CONFLICT RESOLUTION
It is noted that Casa Batlló is not adhered to any consumer dispute resolution platform or arbitration, being available to its Users-customers through the customer service channels listed on the Website. However, in accordance with Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, it is informed of the existence of a European platform for online dispute resolution, which can be used in the field of e-commerce; more information can be obtained at:

1.13 APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law. Any dispute arising from the interpretation or execution that may arise in relation to the validity, interpretation, compliance, or resolution of this contract shall be submitted to the jurisdiction and competence of the courts and tribunals of the city of Barcelona (Spain), with a waiver of any jurisdiction that may correspond to the User, provided that the applicable law allows it and it is not a final User, in which case it shall be submitted to the jurisdiction and competence of the courts and tribunals of the User's domicile, or of the city of Barcelona (Spain), as the place of performance of the obligation, at the claimant's choice.
