Privacy Policy

1. Who is responsible for the processing?

Under the Personal Data Protection regulations, the User (hereinafter, the "User") hereby authorizes the personal data provided through the website (hereinafter, the "Website") to be processed by CASA BATLLÓ, S.L.U. (hereinafter, "Casa Batlló"), whose details are as follows:

2. What is the purpose and legal basis for processing your Personal Data?

The Personal Data provided by users through the Website will be processed for the purposes detailed below, based on the legitimacy bases indicated:

  • If the User registers through the "Create an account" section of the Website, Casa Batlló will process their data for the purpose of identifying them, generating credentials to validate them as a registered User, and carrying out the enabled actions and requests, including accessing their private area or any available functionality. The legal basis enabling the processing of their data is the execution of the pre-contractual relationship with the User.

  • If the User places an order, their data will be processed by Casa Batlló to manage their order, with the legal basis enabling the processing being the execution of the contractual relationship with the User.

  • If the User submits doubts, questions, comments, or complaints through the contact form, Casa Batlló will process their data to address the submitted requests, with the legal basis being the pre-contractual relationship with the User.

  • If the User subscribes to the newsletter, their data will be processed by Casa Batlló to send it to them, provided that Users have not objected to receiving it, with the legal basis enabling the processing being the consent provided by the User upon subscription.

  • If the User is a customer, we will send commercial communications to inform about products similar to those acquired, unless they indicate otherwise. The legal basis for processing is legitimate interest.

The relationship between a User and Casa Batlló occurs within the context of Casa Batlló's activities. Therefore, we understand that there are reasonable expectations for the interested party to receive informative, promotional, and/or advertising communications related to activities and events.

In this sense, the regulations themselves allow the provider to send commercial communications regarding products or services of their own company that are similar to those initially contracted by the customer.

In any case, in each electronic communication sent, the User can unsubscribe to stop receiving this type of communication. Additionally, the section "What rights do Users have?" of this Policy explains how to request unsubscribing from these communications.

If the data is processed based on your consent, the User may withdraw their consent at any time, via email to info@casabatllo.cat. However, withdrawing consent, or objecting to the processing of your data, will not affect the lawfulness of processing carried out prior to such withdrawal.

3. How long will personal data be processed?

Casa Batlló will retain Users' Personal Data only for the time necessary to achieve the purposes for which it was collected, until consents are revoked, and for the duration of the relationship between the User and Casa Batlló.

Subsequently, if necessary, Casa Batlló will continue to retain the data properly blocked, in case it needs to address any liability arising from the processing, and until the legally established prescription period.

4. Who are the recipients of personal data?

The User's personal data may be disclosed to the following entities:

  • To Casa Batlló's group companies because we manage certain activities or issues jointly.
  • To service providers who help us carry out our activity, such as courier companies, online payment platforms, IT tools, technical support services, etc.
  • In cases where necessary to comply with our legal obligations, to public authorities, judges, courts, etc.

5. Are international transfers made?

To fulfill the aforementioned purposes, we may rely on service providers located outside the European Economic Area or in countries that have not been declared to have an adequate level of protection. In any case, we ensure the security and legitimacy of the processing of the User's personal data.

To do this, we require the appropriate guarantees from these service providers in accordance with the GDPR, such as having binding corporate rules that ensure information protection similar to European standards, or subscribing to the latest standard contractual clauses approved by the European Commission. 

6. What Rights do Users Have?

As the data subject, the User can send a written request to Casa Batlló, to the address indicated in the header of this Privacy Policy, attaching a photocopy of their ID document, at any time and free of charge, to exercise the following rights:

a) Right of Access:

You will have the right to know whether Casa Batlló is processing your personal data and, if so, to access such data and receive information about the purposes for which it is processed, the categories of data affected by processing, the recipients to whom your personal data has been disclosed, and the expected retention period of the data, among other information.

b) Right to Rectification and Erasure:

You will have the right to request the erasure of personal data when legal requirements are met, and the rectification of inaccurate data concerning you when, among other reasons, it is no longer necessary for the purposes for which it was collected.

c) Restriction of Processing, Withdrawal of Consent, and Total or Partial Objection to Processing:

Under certain circumstances (for example, if the requester disputes the accuracy of their data while accuracy is being verified), you may request that the processing of your personal data be restricted, with such data being processed only for the exercise or defense of legal claims.

You will also have the right to withdraw your consent and to object to processing at any time, for reasons related to your particular situation, in case the processing is based on our legitimate interest or the legitimate interest of a third party (including processing aimed at direct marketing and the creation of corresponding profiles). In this case, Casa Batlló will cease processing, except for the demonstration of legitimate grounds.

d) Data Portability:

You will have the right to receive the personal data you have provided to Casa Batlló in a structured, commonly used, and machine-readable format, and to transmit it to another data controller without hindrance from the data controller to which it was provided, in cases legally established for this purpose.

e) Automated Individual Decision-Making:

In addition to the aforementioned rights, in case automated decisions are made, including profiling, you will have the right to obtain human intervention from Casa Batlló, to express your point of view, and to challenge the decision.

f) Others:

Likewise, when personal data is transferred to a third country or to an international organization, you will have the right to be informed about how to access or obtain copies of the appropriate safeguards relating to the transfer.

Additionally, you may file a complaint regarding the protection of your personal data with the Spanish Data Protection Agency at the address C/ Jorge Juan, 6, 28001 - Madrid, if you believe that Casa Batlló has violated the rights recognized by the applicable data protection regulations.
